APP ====================================================== CORAM: HONOURABLE MR. JUSTICE MADHURESH PRASAD ORAL ORDER 25-02-2021 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Sitamarhi P.S. Case No.724 of 2018 for the offence punishable under Sections 386, 387, 506, 120B/34 of the Indian Penal Code, which is pending in the court of the learned Chief Judicial Magistrate, Sitamarhi.

The informant has alleged that the instant petitioner has threatened him based on earlier attempt on his life and demanded Rangdari from the informant on telephone. The informant's cousin was earlier done to death on account of such demand for Rangdari and therefore, the F.I.R. has been lodged. Counsel for the petitioner submits that other than suspicion, the reason for the petitioner's implication is his past

Patna High Court CR. MISC. No.37918 of 2020(3) dt.25-02-2021 2/2 implication in 12 cases. The petitioner happens to be in custody since 06.09.2019. He submits that it is a case of false implication.

Learned APP for the State has opposed the prayer for bail.

Considering the rival submissions, this Court, for the present, is not inclined to allow the prayer for bail. The same is rejected.

This Court would expect that the petitioner's counsel would honour his undertaking in the instant proceedings regarding supply of the requisite court fee etc. within two weeks from the date he is called upon to do so by the office. (Madhuresh Prasad, J) PNM U T
