Petitioner seeks bail in Ram Krishna Nagar P.S.Case No.129 of 2018 registered for the offence under Section 376 of Indian Penal Code.
Allegation against the petitioner is of committing rape upon the informant.
Submission of the learned counsel for the petitioner is that the whole allegation against him is false and concocted as eight renters were living in the same house along with their family but none of them could see anything or come forward to be a witness.
Heard the learned A.P.P. also who has opposed the prayer and from the impugned order also it appears that the informant in her statement recorded under Section 164 Cr.P.C. has
Patna High Court Cr.Misc. No.45709 of 2018 (3) dt.11-09-2018 2/2 supported the prosecution case.
Having heard both sides and in view of the facts and circumstances of the case, as stated above, I am not inclined to grant bail to the petitioner. Hence, the prayer for bail of the petitioner is rejected.
However, trial court is directed to expedite the trial. The application is dismissed.
