JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 16.01.2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends her arrest in connection with a case registered under sections 302, 201/34 of the Indian Penal Code.
Petitioner is named in the first information report and it is alleged that she along with co- accused Meena Devi instigated other accused to kill the informant's son and also in course of occurrence, she as well as Meena Devi pushed father of the informant. The first information report goes to show that deceased was assaulted by other accused and the petitioner even does not touch the body of the deceased.
No doubt, I am conscious that the petitioner is seeking pre-arrest bail but the petitioner is a lady and her entire family has been made accused in this case.
Patna High Court Cr.Misc. No.44870 of 2016 (3) dt.16-01-2017 Accordingly, it is ordered that in the event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Ara in Narayanpur P.S. Case no. 19/2016 subject to condition as laid down under section 438(2) of the Cr.P.C. shahid (Hemant Kumar Srivastava,J) U T
