JUSTICE SANJAY PRIYA ORAL ORDER 20-01-2017 Heard learned counsel for the petitioners and the State.

The petitioners seek bail in a case instituted for the offence under Sections 420, 379, 411/34 of the Indian Penal Code. It is alleged that while informant was waiting at Hazipur Railway Station for train, three persons came and took the bag of the informant saying to take seal on the money. They did not return. Therefore informant lodged complaint with police. After 2-3 hours, the informant saw those persons and with the help of the police, two persons namely, Bharat Sahani and Manoj Kumar were apprehended and one person fled away. The cloth was recovered from bag which was in possession of the Bharat

Patna High Court Cr.Misc. No.48019 of 2016 (6) dt.20-01-2017 2/2 Sahani and he told that money has been taken by one Tarkeshwar Sahani, who managed to run away.

Learned A.P.P. has submitted that police has mentioned in the case diary that petitioners have no criminal antecedent. Petitioners No. 1 and 2 are said to be in custody since 29.07.2016, and petitioner no.3 is in custody since 19.08.2016. Considering the aforesaid facts and circumstances of the case, let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Sonepur, in connection with Sonepur (Hajipur) Rail P.S. Case No. 62 of 2016, subject to the condition that both the bailors will be the close relative of the petitioners. (Sanjay Priya, J) ravi/- U T
