====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-07-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Piprakothi P.S. Case No. 53 of 2017, registered for the offence punishable under Section 414/34 of the I.P.C. The case of the prosecution is that two persons were apprehended while they were trying to flee away after leaving their tractor upon seeing the police force. The further allegation of the prosecution is that the said two persons disclosed their names as Shambhu Shah and Suresh Shah as well as they disclosed in their confessional statement that the tractor was stolen by them with the help of the petitioner.

Learned counsel for the petitioner submits that though the petitioner has fair antecedent, he has been remanded in one

Patna High Court Cr.Misc. No.33779 of 2017 (2) dt.20-07-2017 2/2 case after being taken into custody in the present case. It is further submitted that no recovery has been made from the possession of the petitioner, no TIP has been carried out and the petitioner is in custody since 17.03.2017.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Piprakothi P.S. Case No. 53 of (Mohit Kumar Shah, J) khushbu/- U T
