JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-07-2019 Heard learned counsel for the petitioners and State. The petitioners are in custody in connection with Barhara P.S. Case No. 41 of 2019 for the offence under Sections 341, 342, 323, 324, 307, 353, 379, 504 and 506/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners have got no criminal antecedent and they are in custody since 30.04.2019. Referring to the prosecution case, learned counsel submits that there is general and omnibus allegation of assault against the accused persons. The petitioners are the husband and wife.

Considering the fact that the petitioners have got clean antecedent and there is general and omnibus allegation of
