1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Mashrakh Police Station Case No. 284 of 2024, disclosing offences under Sections 420, 467, 468, 120-B of the Indian Penal Code.
3. As per the First Information Report, the petitioner in collusion with a Notary Public and other accused, prepared a will by forging the signature of the father of the informant pertaining to property in question.
4. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case by the
Patna High Court CR. MISC. No.46582 of 2024(2) dt.09-08-2024 2/3 informant merely on the basis of the fact that the testator of the will is the informant's father who executed the will in the year 2006 in favour of the sons of the petitioner and nephew of the testator. The probate case bearing Probate Case No. 07 of 2009 has been filed by the legatee which has been converted into the original suit no. 16 of 2013 in which the notice has been issued to the informant and the informant has appeared in the original suit. The co-accused persons i.e., son and nephew of the petitioner has been granted anticipatory bail in Cr. Misc. No. 46283 of 2023 dated 04.08.2023.

Having regard to the submissions made on behalf of the parties and taking into consideration the materials on record and the fact that co-accused persons have been granted anticipatory bail and the informant is the daughter of the legatee, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Saran at
Patna High Court CR. MISC. No.46582 of 2024(2) dt.09-08-2024 3/3 Chapra, in connection with Mashrakh Police Station Case No. 284 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
