The petitioner seeks regular bail in connection with Khaira P.S.Case No.182 of 2017 registered for offences punishable under Sections 272, 273 & 379 and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is about recovery of 2000 pieces of 200 ml. liquor.

Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case. The petitioner has no criminal antecedent and he is in custody since 4.7.2017.

Heard learned A.P.P. also.

Having heard both sides and in view of the allegation, this application is disposed of with direction to the learned trial

Patna High Court Cr.Misc. No.46023 of 2017 (2) dt.19-09-2017 court that once the charge is framed in this case or the petitioner completes four months judicial custody, whichever is earlier, he shall release the petitioner in connection with Khaira P.S.Case No.182 of 2017 to his own satisfaction.
