The petitioner seeks regular bail in Sohsarai P.S. Case No.164 of 2017 registered for the offence under Sections 341, 323, 504/34 of the I.P.C. and 25(1-B)A, 26, 35 Arms Act. Allegation against the petitioner as per the First Information Report is that the police apprehended the petitioner from whose possession one pistol was recovered.

Submission of the learned counsel for the petitioner is that nothing has been recovered from his conscious possession. He is in custody since 03.08.2017.

Heard learned A.P.P. also.

From perusal of the impugned order itself it appears that the

Patna High Court Cr.Misc. No.46709 of 2017 (2) dt.21-09-2017 2/2 learned Sessions Judge has observed that the petitioner will be at liberty to renew his prayer for bail after completion of three months in his custody.

Having heard both sides and in such view of the matter, this application is disposed of with direction to the petitioner to renew his prayer for bail after completion of three months in custody before Sessions Judge and he shall consider the prayer for bail, considering that he has no criminal antecedent.
