Learned counsel for the petitioners undertakes to remove the defects as pointed out by the office within four weeks of normal functioning of the court, failing which the office is directed to place the matter before the Bench. The petitioners seek bail in a case registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act. Allegation against the petitioners alongwith other accused persons is of committing torture upon the victim due to non-fulfillment of demand of dowry and at last they killed her.

Patna High Court CR. MISC. No.39820 of 2020(2) dt.10-02-2021 2/2 Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. The petitioner no.1 is the father-in-law and petitioner no.2 is the brother-in-law of the deceased. The husband of the deceased is already in custody. The petitioners are languishing in jail custody since 11.08.2020 and have got no criminal antecedent.

Learned APP for the State opposes the prayer for bail petition.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sasaram, in connection with Sasaram Town P.S. Case No. 497 of 2020.
