The petitioner has preferred this application for grant of regular bail in a case registered under sections 363, 366A, 504 and 506 of the Indian Penal Code.

As per the prosecution case, the seventeen year old daughter of the informant was taken away by the petitioner. Inspite of search, she was not to be found.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The daughter of the informant returned and her statement was recorded under section 164 Cr.P.C. which is Annexure-2 to the petition wherein she has not supported the prosecution case. The petitioner is in custody since 3.6.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the contents of the statement of the daughter of the informant under section 164 Cr.P.C. wherein she described her age to be 19 years as also the contents thereof together with the petitioner having remained in custody since 3.6.2021 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with POCSO Case no.59 of 2021 (arising out of Manjhagarh P.S. Case no.153 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge VI-cum-Special Judge, POCSO, Gopalganj.
