2. The present petition has been preferred for the grant of following relief(s):

(i) to quash the Memo No. 558 dated 15.04.2026, issued by the Mineral Development Officer, Sheikhpura (Respondent No. 03), whereby and whereunder the vehicle of the petitioner has been seized and also a fine of Rs. 8,81,600/- imposed to the petitioner.

(ii) for directing the District Magistrate, Sheikhpura (Respondent No. 2) to consider the representation of the petitioner

Patna High Court CWJC No.9177 of 2026(2) dt.02-07-2026 2/3 where the petitioner has clearly mentioned that due to breakdown of vehicle, the petitioner was unable to arrive at the destination within the stipulated time period i.e. 12:43 PMon 14.04.2026. However, he assigned on 15.04.2026 at 7.30 A.M. which is quite possible due to vehicle breakdown.

(iii)for direction to the Respondents to consider the fact as merely due to slight time difference in assign at the destination, and in presence of reasonable delay the memo No. 558 dated 15.04.2026 is not as per law.

(iv) for any other writ/writs, order/orders, direction/directions as this Hon'ble Court may deem fit and proper in the facts and circumstances of this case.

3. After some arguments, learned counsel for the petitioner submit that he shall be submitting his proper application before the Mineral Development Officer, Sheikhpura so that an appropriate order is passed.

4. Learned counsel representing the Mines Department submit that an appropriate order shall be passed in

Patna High Court CWJC No.9177 of 2026(2) dt.02-07-2026 3/3 accordance with law, at an earliest.

5. In that background, the writ petition is disposed of directing the petitioner to approach the Mineral Development Officer, Sheikhpura in next four weeks and if such petition is preferred, the aforesaid respondent is duty bound to take up the matter/hearing the parties and take the matter to its logical conclusion in next three months.
