The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 384 of the Indian Penal Code.
The prosecution case is that on 05.01.2014 at 9.55 P.M. the informant received a telephone call. The caller claimed to be himself of Officer-in-charge, Rajpur police station and thereafter another call was received at 10.08 P.M. when the caller's name is Sunil Kumar, who demanded extortion of rupees ten lakhs.
It is submitted by learned counsel for the petitioner that the petitioner is agnate of the informant. For the
Patna High Court Cr.Misc. No.41790 of 2015 (2) dt.09-10-2015 2/2 occurrence of 05.01.2014 the complaint was filed on 15.11.2014 which came to be registered as police case on 30.04.2015. The informant and her husband are named accused in Nasriganj P.S. Case No. 167 of 2010 under Sections 302, 307, 452, 120B/34 of the IPC and 26/27 of the Arms Act lodged by the petitioner for the murder of his wife and Title Suit No. 55 of 2011 is pending between the parties.
A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecendent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate I/C, Ist Class, Bikramganj, Rohtas in connection with Nasriganj (Rajpur) P.S. Case No. 48 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
