The petitioner, who is in custody, seeks bail in connection with Deo P.S. Case No. 10 of 2015 registered for the offence punishable under Section 395 of the Indian Penal Code. The FIR is registered against 15-20 unknown persons, who committed dacoity in the house of informant. Learned counsel for the petitioner submitted that he is not named in the FIR and nothing has been recovered from his possession. It has further been submitted that his name surfaced in this case on the basis of confessional statement of co-accused Dinesh Choudhary who has been granted bail as contained in Annexure-2 and other co-accused,

Patna High Court Cr.Misc. No.44034 of 2018(3) dt.29-08-2018 2/2 namely Ramadhar Chaudhary has been granted bail by this Hon'ble Court as contained in Annexure- 3. Petitioner is in custody since 28.04.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad, in connection with Deo P.S. Case No. 10 of 2015.
