2. Petitioner seeks bail in connection with Kowakole P.S. Case No. 92/2020 registered for offence punishable under sections 147, 148, 149, 341, 323, 324, 447, 448, 302, 307 and 504 of the Indian Penal Code.

3. As per allegation, the FIR named 17 accused persons including the present petitioner came to the house of the informant and badly assaulted his brothers, namely, Jitendra Ravidas (deceased) and Dharmendra Ravidas (deceased). They also assaulted the mother of the informant and made her injured. The injured Jitendra Ravidas and Dharmendra Ravidas, including the informant and his wife were referred to the hospital. The doctors of Kawakole Government Hospital, perceiving serious condition of Jitendra Ravidas and Dharmendra Ravidas, referred them Nawada. Jitendra Ravidas and Dharmendra Ravidas both died during the course of treatment in Sadar Hospital, Nawada.

4. Learned counsel for the petitioner has submitted that the allegation against the petitioner is general and omnibus in nature and there is no specification about the attribution towards infliction of the injuries on the deceased persons. He

Patna High Court CR. MISC. No.46713 of 2024(2) dt.30-08-2024 2/2 has also submitted that both the deceased sustained three injuries on their persons, whereas according to allegation, 17 accused persons have assaulted them. Petitioner is in custody since 3.5.2024. Petitioner has got clean antecedent. Co-accused, with similar allegation, have already been allowed bail by this Court vide paragraph 13 of the bail petition.

5. Learned counsel for the State opposed the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, Nawada in Kawakole Police Station Case No. 92 of 2020.
