The petitioner seeks bail in C2A No. 47/2019, instituted for offence under Section(s) 30(a) of the Bihar Prohibition and Excise Act, 2016.
It is alleged in the written report that on getting confidential information that in Sukumarapur Diara some persons are preparing illegal liquor with jaggery, the police party reached at the place of occurrence and saw one person was sitting inside a shrub and smoke was coming out from that place. Seeing the police party he started running away with jerkin in his hand but on chase he was apprehended, who disclosed his name as petitioner. It is alleged that in the
Patna High Court CR. MISC. No.38785 of 2019(2) dt.28-06-2019 2/2 aforesaid jerkin Chulhai liquor was found. The police recovered utensils, apparatus and stove meant for making of illicit liquor, from the place of occurrence. Petitioner was found to be in possession of 40 litres of illicit liquor.
Learned counsel for the petitioner has submitted that petitioner is in custody since 05.05.2019 having clean antecedent.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge-cum-Special Judge, Excise Court, Vaishali at Hajipur, in connection with C2A No. 47/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
