The petitioner seeks bail in a case registered under Section 395 of the Indian Penal Code.

Allegation is that seven unknown miscreants looted away Rs.5,73,674/- from the Bank.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.05.2020 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is not named in the F.I.R. His name has come in this case on confessional statement of co-

Patna High Court CR. MISC. No.37766 of 2020(3) dt.15-03-2021 2/2 accused. It is alleged that Rs.30,000/- is said to have been recovered from the joint house of the petitioner. The petitioner had no knowledge regarding the said money in question. The petitioner has not been put on T.I.P. to ascertain his participation in the alleged occurrence. Other co-accused has been granted bail vide Cr.Misc.No.38545 of 2020. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Mehasi P.S. case No.134 of 2020.
