JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-06-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 307 and other ancillary sections of the Indian Penal Code.

Prosecution case is that petitioner and other accused persons assaulted the police party with iron, danda, chilli powder etc when they tried to rescue Bittu Kumar who was in wrongful confinement of the accused persons.

Learned counsel for the petitioner submits that in fact said Bittu Kumar had entered into the house of petitioner's niece and tried to commit rape and on protest he attacked the petitioner and in order to save themself, petitioner and other accused persons locked Bittu Kumar in a room. Thereafter police came and took him with them.

In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, I, Patna city in Fatuha Police Station Case No. 516 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
