The impugned order has been passed by learned Additional Sessions Judge in a case registered under the provisions of SC/ST (Prevention of Atrocities) Act, Indian Penal Code and Arms Act and according to new amendment of SC/ST (Prevention of Atrocities) Act, the order passed by the Special Court is an appellable order.
Therefore, in the aforesaid circumstance, this petition does not appear to be maintainable. However, in course of hearing, learned counsel for the petitioner seeks permission for withdrawal of this petition with liberty to file appeal in accordance with law. With the aforesaid liberty, this petition filed in connection with Kasim Bazar P.S. Case No. 95 of 2016 stands dismissed as withdrawn.
