The petitioner has filed the instant application for grant of regular bail in connection with Nawanagar P.S. Case no. 179 of 2020 registered under sections 307 147, 148, 149, 341, 323, 379 and 504 of the Indian Penal Code. As per allegation in the F.I.R., the seven named accused persons including petitioner herein are stated to have abused and assaulted the informant and others causing serious injuries.
It is submitted by learned counsel for the petitioner that the allegation as levelled in the F.I.R. are false and incorrect. There is case and counter case between the parties and
Patna High Court CR. MISC. No.38197 of 2020(2) dt.05-02-2021 2/2 the correct version has been given in the F.I.R. lodged by the petitioner himself which is Annexure-2 to the petition. It is submitted that the allegations are general and omnibus in nature, the petitioner is in custody since 09.06.2020 and charge sheet has been submitted in the case. The petitioner has no criminal antecedent.
The application for bail is opposed by learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the case and counter case between the parties and charge sheet having been submitted in the case, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Nawanagar P.S. Case no. 179 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar.
