====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 09-10-2015 Learned counsel for the petitioners is permitted to make correction in the name of father of the petitioners in the cause title.

Heard learned counsel for the petitioners and the State.

Petitioner are apprehending their arrest in connection with a case registered for the offences under Sections 341, 354, 504, 506 and 511 of the Penal Code and Section 3(i)(X)(XI) of the Scheduled Castes/Scheduled Tribes (Prevention of Atrocities) Act.

It is submitted on behalf of the petitioners that present case has been registered

Patna High Court Cr.Misc. No.40392 of 2015 (2) dt.09-10-2015 against the two and their father Md. Habib as their father Md. Habib has filed a case against Mohan Paswan the informant in which informant also went to jail, after being released the present case has been lodged. It is also submitted that besides the present case and one another case referred to in the Written Report of the present case i.e. Siwaipatti P.S. Case No. 7/2015, there is no third case registered against the petitioners.

Let petitioners, named above, surrender in the court below within four weeks from the date of receipt/production of a copy of this order in the court below, thereafter court below will verify from the case diary as also from other records about antecedent of the two petitioners, if any third case is found registered against either of the petitioners, their prayer for bail shall be considered in accordance with law, otherwise they be released on bail on furnishing bond of Rs. 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Siwaipatti P.S. Case No. 25/15,

Patna High Court Cr.Misc. No.40392 of 2015 (2) dt.09-10-2015 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
