JUSTICE SANJAY PRIYA ORAL ORDER 01-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Industrial Area P.S. Case No. 35 of 2017 instituted for the offences under sections 30 (A) and 37 (B) of Bihar Excise (Amendments) Act, 2016.

It is alleged that the petitioner was found in intoxicated condition and also disclosed that he is running illegal wine business in the house of one Jwala Singh and in the course of search, 14 Foreign wine bottle containing 375 M.L. and 6 bottles of Imperial Black Company wine were recovered from there. It is further alleged that the petitioner was checked by breath analyzer and was found Alcoholic13.5.7 Mg/10 ML due to which the petitioner was apprehended and he is in custody since 03.05. 2017.

In the facts and circumstance of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District AND Sessions Judge-4th -cum- Special Excise Judge, Bhagalpur in connection with Industrial Area P.S.Case No. 35 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
