Heard learned counsel for the petitioners and learned APP for the State.

The petitioners seek bail in a case instituted for the offences under Sections 363/34, 302, 201 and 120(B) of the Indian Penal Code.

The prosecution allegation in short is that the son of the informant was done to death by the accused persons in suspicious condition.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 4.2.2019 and have got no

Patna High Court CR. MISC. No.38883 of 2019(2) dt.03-07-2019 2/2 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. Charge-sheet has been submitted in the present case. The petitioners are father-in-law and mother-in-law of the deceased. There is no eye witness to the alleged occurrence nor there is any circumstantial evidence to suggest the implication of the petitioners in the present case. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-VIII, Madhubani in connection with Pandaul P.S.
