2. The petitioner seeks bail in a case registered for the offence punishable under Sections 75, 76, 78 and 3(5) of the B.N.S..

3. As per prosecution case, it is alleged that this petitioner, along with other F.I.R. named accused persons, misbehaved with sister of informant while she had gone to attend the call of nature.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. Petitioner has falsely been implicated in this case with ulterior motive. Specific accusation of attempting to commit rape is against other co-accused persons and so far as this petitioner is

Patna High Court CR. MISC. No.39591 of 2025(3) dt.31-10-2025 2/2 concerned, no specific accusation of overt act has been alleged against him. Petitioner has got no criminal antecedents and he is in custody since 24.04.2025. Moreover, charge-sheet has already been submitted.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the facts and circumstances of the case, period of custody and clean antecedents of the petitioner, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Vaishali at Hajipur in connection with Bidupur P.S.
