JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-09-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are said to have assaulted the informant and others by means of rod, sword etc., as a result whereof five persons including informant sustained injuries but submission on behalf of the petitioners is that there is case and counter case between the parties and persons from both the sides sustained injuries. It is further submitted that, moreover, due to intervention of well wishers, both the parties settled their dispute amicably and taking note of the aforesaid fact of compromise, this court has already granted privilege of bail to prosecution party in Bajpatti
Patna High Court Cr.Misc. No.38765 of 2016 (2) dt.19-09-2016 2/2 P.S.Case No. 100 of 2016.
From perusal of the impugned order, it would appear that two injured of this case sustained injuries on their vital parts of the body but learned Additional Sessions Judge, Sitamarhi does not disclose the nature of injuries sustained by the above stated injured in the impugned order and, therefore, it is presumed that injured of this case have sustained simple injuries. Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Pupri at Sitamarhi in connection with Bajpatti P.S.Case No. 99 of 2016.
