2. The petitioner has moved the Court under Section 102 of the Juvenile Justice (Care and Protection of Children) Act, 2015 against the order dated 07.06.2018 passed in Criminal Appeal No. 35 of 2018 by which the order dated 20.09.2017 passed by the Juvenile Justice Board, Bettiah in Juvenile Justice Board Case No. 567 of 2017 rejecting the application for declaring the petitioner as juvenile, has been dismissed.
3. At the very outset, learned counsel for the petitioner submitted that after such rejection trial has proceeded against the
Patna High Court CR. REV. No.795 of 2018 dt.13-08-2019 2/2 petitioner treating him to be an adult in Sessions Trial No. 460 of 2017 in which he has also been convicted.
4. In such view of the matter, learned counsel for the petitioner submitted that the present application may be allowed to be withdrawn with liberty to the petitioner to raise all points available to him in the appeal filed by the petitioner against his conviction in Sessions Trial No. 460 of 2017.
5. In view thereof, the application stands disposed off as withdrawn with liberty aforesaid.
