The petitioner apprehends her arrest in connection with Gogari P.S. Case No. 150 of 2014, registered under Sections 341, 323, 325, 385 and 379/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that, in fact, occurrence took place due to land dispute, in which, petitioner's side also sustained injury, regarding which, Gogari P.S. Case No. 149 of 2014 is also instituted on the basis of written report of one of the co-accused in the present case. It is further submitted that while petitioner, who is an old lady, is named in the F.I.R. but no specific overt act has been attributed

Patna High Court CR. MISC. No.39308 of 2019(2) dt.27-06-2019 2/2 against her. Further submission is that the police on investigation, submitted final form against the petitioner but the learned Judicial Magistrate differing with the final form took cognizance against her and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Khagaria, in connection with Gogari P.S. Case No. 150 of 2014, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
