The petitioners seek bail in anticipation of their arrest in connection with Madhepura (Ghailarh O.P.) P.S. Case No. 292 of 2020, dated 15.04.2020, instituted for the offences under Sections 447, 341, 323, 504, 307, 354(B) and 379 of the Indian Penal Code.

Patna High Court CR. MISC. No.38069 of 2020(2) dt.16-04-2021 2/3 Though the petitioners have been named in the F.I.R. but the accusation against them is general and omnibus. The injuries suffered by the victims are all stated to be simple in nature.

The learned counsel for the petitioners has submitted that there is a counter version of the occurrence also lodged by the petitioner No. 1 in which both the petitioners have received grievous injuries. He has further submitted that there is a long standing dispute between the parties and it is only because of such dispute that the occurrence has taken place and the allegations against the petitioners have been exaggerated in the subject F.I.R. Regard being had to the facts afore-stated, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura (Ghailarh O.P.)

Patna High Court CR. MISC. No.38069 of 2020(2) dt.16-04-2021 3/3 P.S. Case No. 292 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
