JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-02-2017 The petitioner is in custody since 05.10.2016 in connection with Sahpur (Karnamaypur) P.S. Case No. 243 of 2016, registered for offences punishable under Section 395 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that though the allegation against the petitioner is that he was watching the movement of the informant and informed the co-accused persons of this case, who snatched Rs. Ten Lakhs, two mobile phones and a golden chain, however no material has come to suggests the petitioners involvement. Nothing has been recovered from the possession of the petitioner nor the articles recovered has been put on T.I.P and the petitioner has been in judicial custody

Heard learned A.P.P. also.

Having heard both side, in view of the fact that thre is no legal evidence on record so as to show the complicity of the petitioner in the present case and petitioner has no criminal antecedent and has been in judicial custody since 05.10.2016, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-XIV, Bhojpur at Ara, in connection with Shahpur (Karnamaypur) P.S. Case No. 243 of 2016, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the
