The petitioner namely Pramod Kumar Singh is in custody since 27.03.2016 in Marhaura P.S. Case No.138 of 2016 under Section 379 and 411 of the Indian Penal Code. According to the prosecution case, the informant lodged F.I.R. alleging that this petitioner committed theft of the motorcycle of the informant. The defence is that petitioner and the informant are relation and the petitioner had given advance of Rs.50,000/- to the informant and for that, the informant had given the motorcycle to the petitioner on the condition that when he will return the money, the motorcycle will be returned. No.39051 of 2016 (2) dt.17-09-2016 custody since last six months and both the parties are relation, I direct that the petitioner named above be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Chief Judicial Magistrate, Saran at Chapra, District-Saran in connection with Marhaura P.S. Case No.138 of 2016.
