The petitioners seek bail in a case instituted under Sections 25(1-b)a/26 of the Arms Act.

Allegation is that one country made pistol along with five live cartridges has been recovered.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 12.5.2017. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioners. One country made pistol along with five live cartridges is said to have been recovered. There is no compliance of Section 100 Cr.P.C. On behalf of the State, it is submitted that the petitioners

Patna High Court Cr.Misc. No.42597 of 2017(2) dt.20-09-2017 2/2 are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Mojahidpur (Babarganj) P.S. case No.98 of 2017.
