JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-09-2022 Though the present writ petition was filed for making payment of the leave encashment amount and the benefits of A.C.P/M.A.C.P., however, the respondent-State has filed a counter affidavit, wherein it has been stated that a sum of Rs. 5,72,320/- has already been paid by the respondent-State to the petitioner on the head of leave encashment, however, it is submitted by the Ld. Counsel for the petitioner that the petitioner should have been paid a sum of Rs. 6,96,640/- on the head of leave encashment.

As far as grant of benefits of A.C.P and M.A.C.P., are concerned, it is stated by the learned counsel appearing for the respondent-State that since the petitioner has not handed

Patna High Court CWJC No.15848 of 2021(4) dt.28-09-2022 2/2 over the complete charge and huge amount of money has been embezzled by the petitioner, the same would be paid after the petitioner hands over the charge and clears the account, to which the learned counsel for the petitioner has submitted that he has already handed over the charge and has also given the calculations regarding the amount spent by him, hence, the petitioner be granted liberty to approach the District Magistrate, Bhagalpur, for redressal of his subsisting grievances. Liberty so sought is granted.

The writ petition stands disposed off.
