2. The petitioner seeks regular bail in a case registered for the offence under Sections 30(a), 32(1), 32(2), 41(1) of the Bihar Prohibition and Excise (Amendment) Act, 2018 and under Section 420, 467, 468, 471, 120(B) of the Indian Penal Code.

3. As per the prosecution case, petitioner is the driver of the truck from which the illicit liquor has been recovered.

4. Learned counsel for the petitioner submits that nothing incriminating has been recovered from the possession of the petitioner and he is in custody since 11.01.2024.

5. Learned A.P.P. has vehemently opposed the

Patna High Court CR. MISC. No.45683 of 2024(2) dt.03-07-2024 2/2 prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge-II, Bhojpur at Ara/concerned Court below in connection with Piro (Hasanbazar) P.S. Case No. 15 of 2024 subject to condition that:- 7(i). One of the bailor should be blood relative of the petitioner.
