The petitioner is accused of Narpatganj P.S. Case No. 226 of 2016 registered under sections 363 & 366-A IPC. The father of the victim lodged the case that his minor daughter aged about 16 years was kidnapped by the petitioner. The victim girl, upon recovery, made a statement which is placed at Annexure-3. It appears that she has alleged her abduction/kidnapping by the petitioner.
The contention of the petitioner is that the petitioner was having affairs with the victim and has also married. An affidavit, in this regard, has also been filed. The petitioner is in custody since 30.07.2016.
Patna High Court Cr.Misc. No.48033 of 2016 (2) dt.25-11-2016 2/2 Learned APP opposed the prayer and submitted that there is specific allegation against the petitioner which has been supported by the victim in her statements recorded under section 164 Cr. P.C.
Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Prayer is accordingly rejected.
The petitioner shall have liberty to renew his prayer for bail in the court below if the trial does not record adequate/sufficient progress/headway within six months from the date of receipt/communication of a copy of this order. (Kishore Kumar Mandal, J) HR/- U T
