The petitioner, who is in custody, seeks bail in connection with Naugachia P.S. Case No. 38 of 2017 registered for the offences punishable under Sections 364, 302, 201/34 of the Indian Penal Code.

Informant who is the brother of deceased has alleged that petitioner along with other co-accused persons kidnapped his younger brother and thereafter killed him. It has been further submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case only on suspicion. It has been further submitted that there is land dispute between the parties and no eye witness of the occurrence. It has been further submitted that similarly

Patna High Court Cr.Misc. No.43972 of 2018(3) dt.26-09-2018 2/2 placed co-accused persons, namely, Md. Maksood and Anguri Khatun have been granted bail by this Hon'ble Court as contained in Annexure-2. Petitioner is in custody since 04.09.2017.

Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned 1st Additional District and Sessions Judge, Naugachia, District- Bhagalpur, in connection with Sessions Trial No. 32 of 2018 arising out of Naugachia P.S. Case No. 38 of 2017.
