JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-09-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Chhauradano P.S.Case No.47 of 2019 pending in the Court of learned Chief Judicial Magistrate, East Champaran at Motihari registered for an offence under Sections 147, 148, 149 and 302 of the Indian Penal Code.

As per prosecution case, it is alleged that this petitioner along with other accused persons assaulted the deceased brutally with lathi, danda and iron rod as a result of which the deceased died in the hospital during course of treatment.

Considering the aforesaid facts, I am not inclined to

Patna High Court CR. MISC. No.39689 of 2019(3) dt.09-09-2019 2/2 grant bail to the petitioner. Prayer for bail of the petitioner is rejected.
