The petitioners seek bail in a case instituted under Sections 406, 420, 34 of the Indian Penal Code and Section 11 of Gambling Act.
The allegation against the petitioners is of playing gambling with other co-accused persons.
It has been submitted on behalf of the petitioners that the petitioners are in custody since 22.09.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioners. The main allegation has been made against Anand Shankar Ojha. The
Patna High Court Cr.Misc. No.51160 of 2016 (2) dt.29-11-2016 2/2 petitioner has been made accused due to mistake of fact. On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Buxar in connection with Buxar (Town) P.S. Case No. 440 of 2016. (Sudhir Singh, J.) Amit/- U T
