Petitioner is seeking regular bail in connection with Paroo P.S. Case No. 13 of 2017, registered for the offence alleged under Section 414 of the Indian Penal Code, Sections 25 (1-b)A, 26,35, 25(1-A), 25(1-AA), 25(1-AAA) of Arms Act, 3⁄4 of Explosive Substance Act and Sections 16, 17, 18, 18(A), 19,20,21 of U.A.P. Act.
Learned counsel for the petitioner submits that the involvement of the petitioner in the present case by the informant who is a police officer as result of a prosecution lodged by the uncle of this petitioner against the police officer vide Annexure-2 which is Paroo P.S. Case No. 214 of 2016 registered on
Patna High Court Cr.Misc. No.32556 of 2017 (3) dt.20-07-2017 2/2 02.10.2016. The present case has been lodged on 14.01.2017 in which the petitioner is said to have been arrested with a country made pistol and five live cartridges. Learned counsel further submits that it is a case of false implication. The petitioner is in custody for last 6 months. Investigation is complete and charge sheet has already been submitted. Learned counsel further submits that although the petitioner has also been made accused in one more case under the arms act, however in the said case he has been granted bail by the court below statement to this effect has been made in paragraph-3 of this application. Considering the facts and circumstances of the case, let the petitioner, namely, Santosh Sahni be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge -cum- Special Judge, Muzaffarpur, in connection with Paroo P.S. Case No. 13 of 2017, subject to the conditions U/s 437(3) Cr.P.C.
