The petitioner, who is in custody, seeks bail in connection with Bachhwara P.S. Case No. 79 of 2018 registered for the offence punishable under Section 457, 380/34 of the Indian Penal Code and Section 411 of the Indian Penal Code. Informant in his written report has stated that on 28.04.2018 at about 7.00 PM after locking his room he went to market and while returning he saw three accused persons as named in the FIR to have stolen T.V. and Rs. 500/- kept in his room.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. The stolen T.V. was recovered from the shop of Upendra Bhagat.

Patna High Court Cr.Misc. No.45270 of 2018(3) dt.20-08-2018 2/2 It has been further submitted that two similarly co-accused persons have been granted regular bail by this Court as contained in Annexure-2. Petitioner has no criminal antecedent and he is in custody since 30.04.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Begusarai, in connection with Bachhwara P.S.
