JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-09-2018 The petitioners are in custody since 24.4.2018 in connection with Imamganj P.S. Case No. 95 of 2017, registered for offences punishable under Sections 302 and 201 of the Indian Penal Code.
Petitioners are not named in the F.I.R. and as per F.I.R., there is allegation that dead body of one Dharmendra was found and it is alleged that Dharmendra had love affairs with Veena Kumari and later on, name of the petitioners transpired during the course of investigation.
Submission of learned counsel for the petitioners is that petitioners have been named only in the supplementary charge sheet and no specific case has come against the petitioner and petitioners are also not the family members of Veena Kumari and
Patna High Court Cr.Misc. No.45699 of 2018 (3) dt.12-09-2018 2/3 one of the co-accused Manoj Pandey, whose case is similar to that of the petitioner had been granted bail by a Co-ordinate Bench of this Court vide order dated 11.1.2018 passed in Cr. Misc. No.50996 of 2017.
Heard learned A.P.P. also, who has opposed the prayer for bail of the petitioners.
Considering the aforementioned facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sri Gorakh Nath Dubey, Judicial Magistrate, Ist Class, Sherghati, Gaya in connection with Imamganj P.S. Case No. 95 of 2017, with following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on their part to appear before the court below on two
Patna High Court Cr.Misc. No.45699 of 2018 (3) dt.12-09-2018 3/3 consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of their bail.
