The petitioner seeks bail in connection with Ujiarpur P.S. Case no. 65 of 2017 registered for the offence punishable under Sections 147, 148, 149, 341, 342, 323, 332, 333, 307, 353, 379, 427 and 504 of the Indian Penal Code and Section 3/4 of Public Property Damages Act.
The informant of this case happens to be an A.S.I. of Ujiarpur P.S. It has been alleged that after getting information on his mobile, he visited at the place of occurrence, where he saw that a Kirana shop was set ablaze. After arrival of police party, altogether 150 accused persons including this petitioner intercepted the police party and assaulted by means of rod and
Patna High Court Cr.Misc. No.33198 of 2017 (2) dt.20-07-2017 2/2 lathi. Some of the police personnel sustained injuries. It is submitted that the allegation is omnibus against all the accuseds. The petitioner is in custody since 29.04.2017. He has clean antecedent except one case more which was registered after the present case.
Considering the facts and circumstances of the case, the bail prayer of this petitioner is allowed. The above named petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Samastipur in connection with Ujiarpur P.S.
