2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 341, 323, 324, 504, 506, 307, 354, 448, 379 and 34 of the Indian Penal Code.
3. As per prosecution case, on the alleged date and time of occurrence, while the informant was cooking food in her courtyard, in the meanwhile, these petitioners, along with other F.I.R. named accused persons, armed with lathi, danda and iron
Patna High Court CR. MISC. No.45403 of 2024(2) dt.30-07-2024 2/3 rod, came there and assaulted informant and her family members. It is further alleged that they also snatched away jewelry.
4. It is submitted by learned counsel appearing on behalf of the petitioners that both parties are neighbors and present case is counter-blast of Ashok Paper Mill P.S. Case No. 12 of 2024, which was lodged by Petitioner No. 1 against the informant and others. It is further submitted that allegation of assault is general and omnibus.
5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the aforesaid facts and circumstances, nature of accusation and case and counter-case between the parties, the prayer for grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate IX, Darbhanga, in connection with Ashok
