The petitioner seeks bail in connection with Tajpur (Waini) P.S. Case No.255 of 2017, registered for the offence punishable u/s 324, 326, 307, 120B of the IPC and 27 of Arms Act.

As per the prosecution case, petitioner and other coaccused persons indiscriminately fired upon the informant's side due to which they got injured.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. He has been falsely implicated in this case due to enmity. There is general and omnibus allegation against the petitioner. The petitioner has seven criminal antecedent and

Patna High Court CR. MISC. No.45649 of 2024(2) dt.02-08-2024 2/2 has been rotting in judicial custody since 25.11.2020. 5.

Learned APP for the State opposed the prayer for bail. 6.

Having regard to the facts and circumstances of this case as well as considering the nature of offence, I am not inclined to grant bail to the petitioner. The prayer for grant of bail on his behalf is hereby rejected.

Accordingly, this application is dismissed.

However, petitioner is at liberty to renew his prayer for bail after framing of charges.
