JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sitamarhi P.S. Case No. 01 of 2015 registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. rather in course of investigation, one Abhijit Kumar @ Prince Kumar was apprehended by the police, who disclosed the name of this petitioner, except that there is nothing against the petitioner showing the involvement in the present case. It is further submitted that petitioner is accused in three other cases, but in all three cases, he is on bail and in the present case, he is in custody

Patna High Court Cr.Misc. No.242 of 2017 (2) dt.12-01-2017 since 20.06.2016. It is further submitted that similarly situated coaccused, Prince Kumar Singh @ Prince @ Abhijeet, has already been granted privilege of bail by this Court vide order dated 19.08.2015 passed in Criminal Misc. No. 31440 of 2015. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi P.S. Case No. 01 of 2015. Out of two sureties, one surety must be the close relative of the petitioner.
