JUSTICE RAKESH KUMAR ORAL ORDER 22-12-2016 Heard Sri Bikramdeo Singh, learned counsel, assisted by Sri Dharmendra Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody only since 30.08.2016 in Rohtas P.S. Case no.152/16 registered for the offence under Sections 20/ 22 of N.D.P.S. Act, has prayed for grant of bail.
Learned counsel for the petitioner, by way of referring to the statement made in paragraph-3 of the petition, submits that the petitioner is having clean antecedent. He submits that the petitioner has been made accused on an allegation of recovery of 5 Kg of Ganja. According to learned counsel for the petitioner, the recovered Ganja is much lesser than the commercial
Patna High Court Cr.Misc. No.49552 of 2016 (2) dt.22-12-2016 2/2 quantity. On the aforesaid ground, a prayer has been made to extend the privilege of bail.
Considering the facts and circumstances, presently I am not inclined to extend the privilege of bail. The petition stands dismissed.
