2. In the present case, the petitioner seeks bail in connection with Ujiyarpur P.S. Case No. 308 of 2023, registered on 16.08.2023 for the offences under Sections 341, 323, 307, 379, 511, 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, some unknown thieves took away the she-buffaloes of the informant and their neighbours. They were given a chase and the buffaloes were recovered. Co-villager of the informant gave further chase and caught hold of a thief but they opened fire on the co-villager. During investigation, the name of the petitioner transpired as

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. The petitioner was not apprehended from the spot and nothing incriminating has been recovered from person or possession of the petitioner. One Dhananjay Yadav was apprehended in Patori P.S. Case No. 534 of 2023 and he disclosed the name of the petitioner in confessional statement alongwith other coaccused persons. But except for this confessional statement, there is no other material against the petitioner. Till date, no Test Identification Parade for the identification of the culprit has been conducted. Charges have been framed. Petitioner is in custody for about 02 years and 07 months since 08.11.2023. Petitioner is having antecedent of nine cases and he is on bail in most of the cases.
5. Learned APP appearing for the State opposes the submission made on behalf of the petitioner. Learned APP submits that the petitioner is having a long criminal antecedent and he appears to be a habitual offender.
6. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the period of custody of the petitioner and submission of charge

No.44136 of 2026(2) dt.08-07-2026 3/3 sheet against him, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, Dalsingsarai/concerned court, in connection with Sessions Trial No. 270 of 2024 arising out of Ujiyarpur P.S. Case No. 308 of 2023, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
