ANJANA MISHRA ORAL ORDER 21-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Rampur Chauram P.S.Case no.19/15 for the offence under Sections 409, 420 of I.P.C. and Section 7 of the E.C.Act.

Learned counsel for the petitioner submits that the allegation against the petitioner is of misappropriation charge of an amount of Rs.45,69,462/-.

Learned counsel for the petitioner submits that in view of the transaction entered into between the parties the petitioner has already submitted a bank guarantee of Rs.8/- lacs. He further submits that the petitioner is willing and ready to deposit 20% of the alleged defalcated amount within a period of eight months and that bank guarantee which was deposited by him may also be adjusted in the said 20% amount.

Considering the aforesaid offer made by the

No.36748 of 2015 (2) dt.21-08-2015 2/2 petitioner let the petitioner, above named, in the event of his arrest or surrender before the court below within three weeks from today be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Jehanabad, in Rampur Chauram P.S. Case No.19/15 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
