Petitioner is accused in Begusarai Town Police Station Case No 544 of 2016, lodged on the basis of suspicion, under Sections 363, 366A of Indian Penal Code wherein subsequently Section 8 of the POCSO Act was also added. The victim girl has subsequently returned and her statement has been recorded under Section 164 of Criminal Procedure Code which is Annexure 2 wherein she has stated that on her own free will, she had gone to Delhi and, thereafter, on return, she has given her statement. The other co-accused, namely, Manish Kumar has already been granted anticipatory bail vide Cr Misc No 19739 of

Patna High Court Cr.Misc. No.33201 of 2017 (2) dt.20-07-2017 2/2 2017 vide order dated 29.05.2017. The instant petitioner is in custody since 04.04.2017.

In the light of the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge I -cum- Special Judge, POCSO, Begusarai in POCSO Case No 1 of 2017 arising out of Begusarai Town Police Station Case No 544 of 2016.
