The petitioner apprehends his arrest in connection with Jamalpur P.S. Case No.11 of 2019 registered under Sections 30 and 32 of the Bihar Prohibition and Excise Amendment Act, 2016.
The accusation is that on receiving secret information about carrying illicit liquor by Sonu Kumar (petitioner), Guddu Kumar and Bablu Kumar, loading on the vehicle bearing Registration No.WB02U-2638, the informant along with other police personnel proceeded for checking of the vehicle and reached at village-Ramchandrapur. At that time, the aforesaid vehicle was seen coming in high speed from Kashopur. On

No.39749 of 2019(3) dt.24-07-2019 2/3 seeing the police vehicle, the aforesaid vehicle bearing Registration No.WB02U-2638 was turned towards power-grid and started moving in high speed. When the aforesaid vehicle was chased, then after stopping the aforesaid vehicle in front of the the power-grid, Sonu Kumar (petitioner), Guddu Kumar and Bablu Kumar started to flee away. While they were chased but they succeeded to flee away. On search of the vehicle bearing Registration No.WB02U-2638, 18 cartoons, each containing 24 bottles of 375 ml. Indian Made Foreign Liquor, and 72 bottles, each containing 375 ml. Indian Made Foreign Liquor, were recovered.
Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot. Moreover, while the informant and other police personnel disclosed that the petitioner along with Guddu Kumar and Bablu Kumar succeeded to flee away after getting down from the vehicle bearing Registration No.WB02U-2638 but the informant and other police personnel did not disclose how they identified the petitioner and others.
