Petitioner is in custody since 25.09.2016 in connection with Ara Town P.S. Case No. 462 of 2016 registered under Section 379 of the Indian Penal Code.

According to the prosecution, one theft motorcycle has been recovered from the house of the petitioner. 4.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has not committed offence and he has falsely been implicated in this case on instance of his cousin brother Rahul Yadav, who confessed before the police regarding theft of motorcycle. Merely on suspicion the petitioner has been arrested and rotting in jail custody since 25.09.2016.

Considering the nature of accusation, let the petitioner,

Patna High Court Cr.Misc. No.49795 of 2016 (3) dt.22-12-2016 above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur at Ara in connection with Ara Town P.S.
